Probate
The loss of a loved one is an emotional, difficult time that we all face. When you combine that experience with the added duty of handling the probate process, it can be that much more stressful. Hiring an experienced probate attorney who can walk you through the process and relive your burden can be invaluable. Typically, a Personal Representative is represented by an attorney to ensure that he or she is fulfilling his or her duties and properly administering an estate.
Initial Consultation: At the initial consultation we will discuss the probate process and review your loved one’s estate, including whether he or she had a will or trust, and whether a probate is necessary.
Opening Probate: This is often the portion of the probate that you will most rely on an attorney’s advice. Going to court can be an intimidating experience, especially when emotions are running high. In order to obtain Letters Testamentary or Letters of Administration, you’ll need to have your documents in order.
Administering the Estate: Depending on the estate, this will also require an attorney’s counsel; alternatively, there may be a lull in the level of activity and require little legal assistance.
Closing Probate: Many are relieved once they reach this stage and ready to put this experience with the legal process behind them. Several documents will need to be filed with the court in order to close probate.
